In what way Facebook uses the data from the visit of Facebook or Instagram pages for its own purposes, to what extent activities on the Facebook or Instagram page are assigned to individual users, how long Facebook stores this data and whether data from a visit to the Facebook or Instagram page is passed on to third parties, is not finally and clearly named by Facebook and is not known to us.

When accessing a Facebook or Instagram page, the IP address assigned to your end device will be transmitted to Facebook. According to Facebook, this IP address is anonymised (concerning “German” IP addresses). Facebook also stores information about the end device of its users (e.g. in the “Registration Notification” function); where required, Facebook is therefore be able to assign IP addresses to individual users.

If you are currently logged in to Facebook as a user, there is a cookie with your Facebook identifier on your end device. This allows Facebook to understand that you have visited this site and how you used it. This also applies to all other Facebook or Instagram pages. Via Facebook buttons embedded in websites, Facebook is able to record your visits to these websites and assign them to your Facebook profile. Based on this data, content or advertising can be tailored to you.

If you want to avoid this, you should log out of Facebook or deactivate the function “Stay logged in”, delete the cookies on your device and exit and restart your browser. Thus, Facebook information which can identify you directly will be deleted. This allows you to use our Facebook or Instagram page without your Facebook identifier being disclosed. If you access interactive functions of the site (like, comment, share, messages, etc.), a Facebook login mask will appear. After a possible login, you will again be recognizable as a certain user for Facebook.

Users’ rights of data subjects

Unfortunately, we cannot comply with our information obligations under Art. 13 EU GDPR, since only Facebook has full access to the user data. If you wish to exercise your rights, please contact Facebook directly. These rights include the following:

Right to information

You can request information from us as to whether and to what extent we process your data.

Right to rectification

If we process your data which are incomplete or incorrect, you can at any time request their correction or completion from us.

Right to deletion

You may request the deletion of your data from us if we process it unlawfully or if the processing interferes disproportionately in your legitimate protection interests. Please note that there may be reasons that prevent immediate deletion, e.g. in the case of legally regulated retention obligations.

Regardless of the exercise of your right to erasure, we will delete your data immediately and completely, unless there is a legal or statutory retention obligation in this regard.

Right to restriction of processing

You may request the restriction of the processing of your data from us if:

• you dispute the accuracy of the data for a period that allows us to verify the accuracy of the data,
• the processing of the data is unlawful, but you refuse to delete it and instead demand a restriction of the use of the data,
• we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims, or
• you have objected to the processing of the data

Right to data portability

You may request that we provide you with your data that you have provided to us in a structured, commonly used and machine-readable format and that you may transmit this data to another responsible party without any hindrance by us, provided that:

• we process this data on the basis of a revocable consent you have given or for the performance of a contract between us, and
• this processing is carried out by automated means. 

In case of technical feasibility, you can request a direct transfer of your data from us to another responsible party.

Right to object

If we process your data for legitimate interest, you can, at any time, enter an objection against this data processing; this would also apply to profiling based on these provisions. We will then no longer process your data unless we can prove compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims. You can object to the processing of your data for the purpose of direct marketing at any time without giving reasons.

Right of appeal

If you believe that we violate German or European data protection law when processing your data, we ask you to contact us in order to be able to clarify any questions. Of course, you also have the right to contact the supervisory authority responsible for you, the respective State Office for Data Protection Supervision.

If you wish to assert one of the above rights to us, please contact our data protection officer. In case of doubt, we may request additional information to confirm your identity.

Facebook Ireland is solely responsible for the implementation of these rights in accordance with Article 15-20 of the GDPR with regard to the data stored by Facebook Ireland after joint processing. You also have a right of objection and right of appeal, as described above, to us.
